93 percent of American voters support requiring background checks on all gun sales, including 89 percent of Republicans and 87 percent of gun owners. To get the job done, however, we need to finally pass two related bills, both of which may be voted on in the House tomorrow.

  • H.R. 8 – Bipartisan Background Checks Act of 2021 requires all guns, with a few exceptions, to be sold from licensed dealers. The “Bipartisan” in the title is aspirational. 
  • H.R.1446 – Enhanced Background Checks Act of 2021 extends the background check time from 3 to 10 days to eliminate the “Charleston Loophole.” 

We expect both to pass the House, but the problem will occur in the Senate, so start calling our senators, and urging friends and family in RED states to call theirs. NOTE: WE AREN’T THE ONLY ONES CALLING! Gun-owners AGAINST background checks are working the phones too.

Of the gun bills we are tracking, these two, AB-1237 and  AB-876, are appearing in the Assembly Public Safety Committee on Tuesday, April 13. If your assemblymember is on this committee (click and see at bottom of this post) CALL them. If not, email them and put this legislation on their radar when it comes to the floor. (Steve Bennett is an email).

Although the latest version of “Violence Against Women Reauthorization Act” just passed the House, 172 GOP legislators voted against it because it expands firearm restrictions against abusers or stalkers, and added protections for gay, bisexual and transgender individuals. Now, it’s off to the Senate and a fight to get to 60 votes. Call your senators and be sure your friends and family in RED places call theirs.

  • I expect Sen. [___] to vote “YES” to close the “boyfriend loophole” that denies some victims equal access to the protections of the federal law against domestic violence.

Even Sen. Manchin (!!!) has stated that Biden’s plan falls short of the revolutionary change that needs to take place to “build back better.” While the Washington Post reported that Biden proposed spending $2.25 trillion on the first part of his jobs and infrastructure plan—with the two-part package possibly topping $4 trillion—the THRIVE Act announced Monday by Sen. Ed Markey (D-Mass.) and other progressives would invest $10 trillion over a decade. Ben Beachy, director of the Sierra Club’s Living Economy Program stated “To match the scale of the crises we face, piecemeal solutions won’t suffice. By investing $1 trillion per year, we can end the unemployment crisis by putting over 15 million people to work in projects that deliver cleaner air, healthier homes, and a down payment on racial, economic, and climate justice.“

Call your senators to vote “YES” on UFW-supported H.R. 1603 – the Farm Workforce Modernization Act, a long-delayed “thank you” for the essential workers who bring us our food. (more info)A berry worker traveled from the Salinas-area to Washington DC to campaign for the Farm Workforce Modernization Act. This essential worker asked lawmakers to consider that “Farmworkers need immigration reform so they can work in the fields without fear.” Fear – hardwired into the fruits and vegetables we enjoy quietly in our homes. “YES” on SB 796 – Return Bruce’s Beach back to the Bruce Family  (more info)
“I hope that the media will use the right word when you report this story today. The county isn’t gifting anyone anything. The county is returning property that was inappropriately taken. We are returning to the Bruce family… property that they rightfully owned.”- LA County Supervisor Holly Mitchell. Return Bruce’s Beach property to the descendants of its rightful owners: Willa and Charles Bruce, the Black entrepreneurs who first purchased the property and built a resort to serve Black families, who were denied access to most Southern California beaches. After suffering harassment by White neighbors, the city of Manhattan Beach seized the property through eminent domain in 1929 at a fraction of its worth, obstensibly to build a park, which wasn’t actually realized until the 1960’s. SB-467 and SB-47 – It’s time to push these environmental justice bills through  (more info)It’s infuriating that, even with a Democratic majority for decades and a supermajority in the CA state legislature since 2018, we’re still asking for the same things in 2021. Maybe we need to look more closely at our “Democrats.” (See article on AB-345)

SB-467 “End Fracking & Harmful Drilling Act” and AB-896/SB-47 – a companion bill that helps employ displaced oil workers to plug old wells, have both been sent to the SENATE Natural Resources and Water Committee for their April 13th agenda. Find the minimal script that best suits each of your legislators. (Yes, call assemblymembers too! Let them know we’re watching.)

For Ventura legislators:

  • Action: If your Democratic legislators are the environmental warriors who wrote these bills, use this script!

How do I know which kind of Democrat friends and family are being represented by? Although the CA Democratic party no longer accepts donations from the oil industry, it can still donate directly to candidates, creating a voting bloc of Democrats who, voting like Republicans, kill or water-down environmental legislation. (The three Democrats who voted “NO” on AB-345 received $142,206 in donations from oil and gas corporations.) Find out how your legislators fared in these scorecards. It takes about 5 minutes to go through them all. Take an average. (Remember, some legislators like Sen. Limón changed office at the last election.)

If you see that their legislator has mediocre-or-worse scores, it’s time to learn who is funding them. Then choose their script below to share with friends and family members.

  • Action: If your Democratic legislators have a good environmental record, use this script:

  • Action:If your legislators are actually part of the reason why, even with a Democratic supermajority, we haven’t been able to pass meaningful oil industry reform, use something like this:
    • Minimal script: I’m calling from [zip code] to ask how Asm./Sen. [__] is going to vote on both SB-467 and its companion bill [AB-896/SB-47]. (WAIT FOR ANSWER) I want [him/her] to know that I’ve been reviewing [his/her] voting record on environmental justice issues with the [__] scorecard(s) [and have looked up [his/her] political donors]. I’m now very [concerned/angry/disappointed] that [he/she] is aiding the interests of the oil industry at the expense of our climate, our environment, our air, our water and the health and lives of both their own workers and [those/my friends/my family] living in nearby communities. The American public is done with the Senate’s dysfunctional legislative graveyard. This procedure must either be abolished, or substantially reformed, as it’s anti-democratic for a minority to be able to permanently block bi-partisan House legislation, especially bills related to basic democracy, like voting access and equal rights. I’m asking [him/her] to immediately engage in collaboration to reform the Senate from the legislative bottleneck it is now to a functioning body, which may include time limits, the “talking filibuster”, and majority-vote carve-outs for bills that reform and protect democracy.

Minimal script for DEM. senators: I’m calling from [zip code] to thank Sen. [___] for cosponsoring and supporting S.1– For the People Act. Please ask the senator to be prepared to use a targeted filibuster to pass this bill and others related to the basic foundations of our democracy, such as H.R.4 – The John R. Lewis Voting Rights Act and H.R. 51 – Washington DC Admission Act. Also, please ask [him/her] to include these best practices for more secure and transparent elections in the bill

  • PAPER BALLOTS: Clarify that every voter shall be offered an Hand-Marked Paper Ballots (HMPB) when voting in person.
  • NO BARCODES: Remove barcodes for recording votes, as their information can’t be verified by the voter.
  • POST PUBLICLY: Scanned images of paper ballots shall be preserved as publicly accessible records.
  • AUDIT: Routine independent audits of all federal elections in addition to Risk Limiting Audits (RLAs)
  • STANDARDIZE RECOUNTS: Public 100% hand count of every federal race with margins of 1% or less.

Addressing corruption, the protection of voting rights, and reforming of campaign finance should be bipartisan priorities to make our democracy better for all Americans, regardless of their political affiliation. Now, GOP-controlled states like ours are passing ugly and embarrassing Jim Crow-style laws, and I expect Sen. [___] to find the moral fortitude to stand up against them by voting for S.1.
