Judicial Activism Fuels Gun Violence

Do we really need more guns in public parks, playgrounds and zoos?

Meet District Judge Cormac Carney who blocked a law signed by California Governor Gavin Newsom that would have prohibited people from carrying concealed guns in 26 places including public parks and playgrounds, churches, banks and zoos. –  AP

Carney serves the  Central District of California  that covers Southern and Central California. It is the most populous federal judicial district with over 19 million people.

How can one unelected official endanger the lives of 19 million people? What was Carney’s justification allowing concealed weapons in public spaces? Why did the MAGA packed Supreme Court rule for more concealed guns on the streets? How many mass shootings have taken place in Judge Cormac Carney’s district? What can you do curb judicial activism?

Start with this map which shows in mass shootings in Carney’s district recorded by the Gun Violence Archive. The map shows 143 incidents in which 186 people were killed and 540 people injured. A mass shooting incident is one which involves more than four injuries or deaths.

MAGA Packed Supreme Court

“Supreme Court Strikes Down New York Law Limiting Guns in Public. The decision, based on a broad interpretation of the Second Amendment, will make it harder for states and localities to restrict guns outside the home… The 6-to-3 decision again illustrated the power of the six conservative justices, all of whom voted to strike down the New York law, in setting the national agenda on social issues. The court’s three liberal members dissented.

The decision is expected to spur a wave of lawsuits seeking to loosen existing state and federal restrictions and will force five states — California, Hawaii, Maryland, Massachusetts and New Jersey, home to a quarter of all Americans to rewrite their laws.” – NY Times

Oh yeah, Republicans claim to care about life … but only till you’re born

Governor Gavin Newsom signed a law that would have prohibited people from carrying concealed guns in 26 places including public parks and playgrounds, churches, banks and zoos. –  AP

U.S. District Judge Cormac Carney blocked the law. Gun rights groups have been aggressively fighting the laws, often winning initial rulings in their favor before heading to appeal. Gun rights groups have gotten a recent boost from the  2022 U.S. Supreme Court decision in New York State Rifle and Pistol Association v. Bruen. It set a new standard for interpreting gun laws which says gun laws must be assessed by whether they are “consistent with the nation’s historical tradition of firearm regulation.” –  Washington Post 

Note: There were no assault weapons like the AR-15 when America was founded. Hence there could be no bans against such firearms at that time. So this Supreme Court justification seems absurd.

Will there be any consequence for Judge Carney when there are more deaths in public spaces from concealed weapon that his decision allowed? No. Carney has a lifetime appointment, just like Clarence Thomas.

TakeAway: Voting is a matter of life or death. Your vote picks the politicians who will appoint judges that determine gun laws. Your life may depend on it. Vote for Democrats.
