Comstock argued for prosecuting anyone who helped others get an abortion. That included anyone who provided abortion medication. The Comstock Act was never officially taken off the books; it was superseded by Roe v. Wade, which guaranteed the right to abortion.

Project 2025 and the radical right wing are now reviving the Comstock Act to use it as a tool to ban the distribution of mifepristone, the drug used for medical abortions. They used that argument in a recent Supreme Court case where opponents of abortion tried to sue the Food and Drug Administration to ban mifepristone’s distribution by mail. Before a 2021 FDA ruling, patients in some states were required to pick up the drug in person. Project 2025 makes it clear that their ultimate agenda is to control all aspects of sex and sexuality, including fertility and reproduction. The overturning of Roe v. Wade was just the first step. Project 2025 lays out plans for a federal ban on all forms of abortion (including medical, i.e. medication such as mifepristone), then, in the future, restricting the availability of birth control, and a possible federal ban on In Vitro Fertilization (IVF).
