To our Senators: Biden must nominate a progressive Black woman for SCOTUS

Tell our Senators: urge Biden to keep his pledge

Justice Breyer has announced that he’ll retire from the Supreme Court at the end of this term. The balance of the Court is already skewed with a 6-3 right wing majority. We can’t lose another seat and we can’t miss this opportunity to make the Court more representative and more progressive.

President Biden has pledged: “Our process is going to be rigorous. I will select a nominee worthy of Justice Breyer’s legacy of excellence and decency. While I’ve been studying candidates’ backgrounds and writings, I’ve made no decision except one: the person I will nominate will be someone with extraordinary qualifications, character, experience and integrity. And that person will be the first Black woman ever nominated to the United States Supreme Court.”

Biden’s pledge has already been met with racist attacks from Republicans and efforts to paint any potential nominee as a “radical.” Unfortunately that means that in addition to Republican resistance to the idea of nominating a Black woman at all, there’s pressure to choose a centrist who would be more likely to get Republican support rather than a progressive nominee.

Senators Feinstein and Padilla are both on the Judiciary Committee and therefore will have an outsized effect on the confirmation process! We’re asking them to urge Biden to keep his pledge to nominate a Black woman, and to emphasize that she must be progressive.

I’m calling to ask the Senator to urge President Biden to nominate a progressive Black woman to the Supreme Court. Biden pledged to nominate a Black woman, and I want him to keep that pledge. I also need Senator [Feinstein/Padilla] to advocate for a progressive nominee who will argue in favor of upholding civil rights and who won’t be deferential to corporations. Thank you.
