Supreme Court Payback To Billionaires

Should Supreme Court Justices taking luxury trip from billionaires be ruling on cases that benefit those billionaires?

Billionaires aren’t stupid. When they fly you to exotic locations in their private jets. Sail you around in mega yachts. They expect something in return. Now the GOP packed Supreme Court with justices beholden to billionaires is about to make it harder for the Federal Government to prosecute financial fraudsters. These justices ignore the stench of corruption and refuse to recuse themselves from ruling on the case that would help their billionaire friends. But, hey there are more luxury trips to be had if the billionaires are pleased…

What is this case about?

The US Supreme Court is now using his case to consider stripping the Securities and Exchange Commission of a key weapon in its arsenal – the ability to go before its in-house judges to seek multimillion-dollar penalties. – Wealth Management

George Jarkesy is a right-wing radio host and former hedge-fund manager. The SEC charged him in 2013 with violating federal securities laws. According to the agency, Jarkesy lied to investors about who was running a pair of funds he founded, what they were investing in, whether they worked with prominent auditors and brokers, and so on. He also allegedly inflated asset values to charge higher management fees.

The administrative law judge ruled in the agency’s favor, imposing civil sanctions on Jarkesy, including various restrictions on his ability to participate in the securities industry and a $300,000 civil penalty. Jarkesy challenged the SEC’s ability to levy those penalties on constitutional grounds. The Fifth Circuit Court of Appeals, which is always up for some mischief these days, sided with him in an expansive decision on how federal agencies can enforce their rules. – TNR

Billionaires rigged system

“Backed by Elon Musk and Mark Cuban, Jarkesy contends that defendants in SEC cases have a constitutional right to make their case to a federal jury. A win for Jarkesy would reduce the SEC’s leverage to extract expensive settlements. 

Jarkesy in 2007 set up the first of two Houston-based funds that eventually raised $24 million from 120 investors. He became a conservative commentator on Fox Business News and CNBC, talking about the financial markets and government regulation… It all came crashing down in 2013, when the SEC accused him of misleading investors about who served as the funds’ prime broker and auditor and about their investment strategies and holdings.” – Wealth Management
